The purchase of any product available through miccys.com is subject to the following ‘General Conditions of Sale’:
Purchase of goods from the website miccys.com site is reserved for private individuals for their personal needs. The purchasing of Miccy’s products from miccys.com with the sole intent of future resale for profit is strictly forbidden.
MICCYS reserves the right to amend/update their ‘General Conditions of Sale’ at any time. Customers are able to acquaint themselves with the current ‘General Conditions of Sale’ on the website.
Prior to making an order from miccys.com, you will be requested to confirm your acceptance of the current ‘General Conditions of Sale’ before any payment will be processed.
TERMS OF ORDER - PURCHASES
The site miccys.com enables customers to purchase on-line a range of branded Miccy’s products directly from Miccy’s via the internet from The Netherlands.
Telephone order can also be made (our order-line number is +31 (0) 70 744 71 22), between the hours of 10 am – 5 pm Monday to Friday, (excluding national holidays and Wednesdays)
Products purchased from the site miccys.com can be delivered all over the world.
Before any order is processed on the site miccys.com, a confirmation page will display automatically, showing a photo of the item selected, chosen color, relevant product code, chosen quantity, appropriate unit price and the total order price, inclusive of shipping.
You will be required to confirm the details of your order prior to payment. Following confirmation and payment, your order will be forwarded to Miccy’s for processing, packaging and dispatch (see “validation of order”).
Every effort is made that color description and photographic representations of Miccy’s goods posted on the site miccys.com are faithful to the original items. However, variations in representation can occur from time-to-time as a result of the technical limitations of some computer equipment with regard to the depiction of colors. Consequently, Miccy’s cannot be held responsible for errors or inaccuracies of the photos or graphic representations posted on the site MICCYS.COM

MICCY’S reserves the right to cancel the order of a customer with whom they have been in dispute regarding previous orders, if MICCY’S reasonably considers that a customer has violated the current ‘General Conditions of Use’ and/or ‘Sale’, or that they have undertaken fraudulent activity of any sort, or for any other justifiable motive.
To ensure a high quality of service and availability of products, purchases on miccys.com of specific product lines are restricted to twenty items within a 14 (calendar) day period. For exceptional purchases, where customers wish to place orders of a particular product line that exceeds this limit, we request that you get in touch directly with our Customer Services team, either by e-mail or telephone.
AVAILABILITY - PURCHASES
The offer of particular product lines at set prices is valid for as long as they are visible on the website, while stocks last. Occasionally, modifications and errors can occur, usually as a result of simultaneous orders of a given product being processed on the website. In the event of an item becoming unavailable after your order being processed, we will endeavor to inform you as soon as possible by e-mail or telephone, and you will be offered a suitable product from the site miccys.com as a suitable replacement or the opportunity to cancel the order and receive a full refund. Should you choose to cancel your order, you can expect to receive a refund no later than 30 days from the date the initial order was placed.
MICCY’S incurs no responsibility in case of shortages of stock, or in the lack of availability of Miccy’s products.
MICCY’S reserves the right to change, at any time and without advance notice, articles proposed on the site miccys.com.
VALIDATION OF ORDER - PURCHASES
At the end of the order process, you are invited to click the "Order" button. Once validated, your order is passed on to MICCYS for processing, packaging and dispatch. It cannot be further modified or nullified, other than in accordance with the present ‘General Conditions of Sale’ or your statutory rights as a consumer. The validation of your order serves as your acceptance of our present ‘General Conditions of Sale’.
Any order under a product appearing in the online store's website miccys.com requires consultation and prior acceptance of these terms and conditions. The click of validation of the order implies full acceptance of these terms. A summary of your order and receipt of payment will be sent to you by e-mail.
The data recorded by the site miccys.com constitutes proof of all transactions undertaken between MICCY’S and their customers. In the case of disputes between MICCY’S and a customer regarding a specific transaction made on the web site, the data retained by MICCY’S is regarded as irrefutable proof of the specific details of the original transaction.
In accordance with the required application of article L. 134-2 of the ‘Consumer Code’, when the value of an order is equal to or exceeds 120 euros in value (excluding shipping costs), MICCY’S is required to retain both a paper and electronic copy of the details of the transaction concluded between MICCY’S and a customer from the date of the placement of the original order through to the date of receipt of the shipment of goods, and then until ten years has passed since receipt of the purchased items (in accordance with decree 2005-137, made on February 16th, 2005).
PRICES PAID - PURCHASES
The prices of Miccy’s products are stated in euro’s and UAE Dirhams, and include VAT. All the custom fees related to your shipment will be at your own expense. The total amount of your order will vary, depending on the delivery option that is selected (see "Delivery Options and Shipping Charges").
MICCY’S reserves the right to modify at any time and without advance notice the prices of products available for purchase on the site MICCYS.com. Products are sold on the basis of prices quoted on the site MICCYS.com at the time of the order being confirmed, subject to stock availability at that time. Price is payable in full in one payment. The seller reserves the right to change prices at any time without prior notice.
Any orders made on the site miccys.com must be settled immediately after the confirmation of order has been made. We only accept debit & credit card payments, PayPal and banc transfers.
All the orders are payable in euros. The following debit/credit cards are accepted: Mastercard®, Visa®. The shipping of your order will not be authorized until notice of payment has been obtained and the consumer has receipt of the appropriate funds.
In cases where particular products are unavailable, the relevant price of said items and associated shipping costs will be refunded to the buyer.

PAYMENT BY CREDIT CARDS
You can pay by credit card, in this case the payment is made on the website of our partner Mollie. This implies that no banking information is transmitted via the MICCYS.com site. Payment by credit card is perfectly secure. Your order will be registered upon acceptance of payment by the banking service. You can pay online with confidence entering the number, the expiration date of your credit card and the security code on the back of it in areas designated for that purpose. The details of your credit card details are encrypted using SSL (Secure Socket Layer) and never transmitted unencrypted over the network. Payment is made directly to the bank. The seller has no access to these details, and does not keep them on its servers. That is why they are called back for each transaction on our site.
STRUGGLE AGAINST FRAUD
The website MICCYS.com reserves the right to verify the validity of the regulation, before shipping the order, by all means the seller deems necessary (including request ID, proof of address, etc. ).
MICCYS.com also reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully paid or a previous order or with whom a payment dispute is currently being administration. In case of fraud or suspected fraud, the seller reserves the right to remove any member without notice or compensation.
RETENTION OF TITLE – PURCHASES
The ordered products remain the property of MICCY’S until full payment is received by MICCY’S. In case of incident payment, you agree to return to the MICCY’S delivered products from the first application.
However, you assume the risks (including loss, theft or damage) relating to the products delivered and the actual delivery date.
DESTINATIONS OF DELIVERY – SHIPPINGS & DELIVERIES
MICCYS.com ships orders within 48 hours from Monday to Friday (except in rare occasions) Promotion's period can drag a little extra delay. If you place your order before 12 noon., it will be shipped the same day. Past this delay, your order will be shipped the following day. Orders placed on a Saturday, Sunday or a bank holiday will be processed on the next working day.
Miccy’s products ordered on the site MICCYS.com can be shipped to any global destination (except otherwise stated).For security reasons, MICCY’S also refuses to process any orders for which only a post office box or a Cedex address is supplied.
All products are sent to the delivery address provided during the order process. The website MICCYS.com is not responsible for the eventual loss of your package by the carrier. However any package lost or misplaced will result in a replacement or refund.
SHIPPINGS & DELIVERIES – TRANSPORT COSTS
All the deliveries are made by the company Post NL - For deliveries abroad, the post of the country takes over once the package arrives in the country. Post NL offers a secured delivery service, the package is only given against signature.
The price for deliveries at home in The Netherlands is free.
The price for deliveries within Europe is 15 Euro.
The price for deliveries abroud depents on the shipping costs.
SHIPPINGS & DELIVERIES – DELIVERY DEADLINE
The average delivery lead time for The Netherlands is 48 to 72 hours.
The delivery lead time for Europe extends between 72 hours and 5 days.
The delivery lead time for the rest of the world is on average five days to 10 days.
Delivery is done in full one, the unavailable products at the time of your order will be neither charged nor shipped. If one of your items was out of stock, an email will be sent and a refund’s procedure will be initiated.
SHIPPINGS & DELIVERIES – CUSTOMS DUTIES
Any order placed on the site and for which the country (or region) delivery is outside of mainland The Netherlands may be subjected to customs duties. These duties are imposed by the regulations of the country. These charges are the customer’s expense. miccys.com is not required to check and inform clients about customs duties and taxes. The customer should check with the relevant authorities of his country before placing an order. In case of refusal to pay customs duties and taxes, any requested and taxed amounts to miccys.com to get back the parcel will be deducted from the refund’s amount of the customer.
SHIPPINGS & DELIVERIES – PROBLEMS OF DELIVERIES
Our Customer Services team must be notified as soon as possible regarding any delays in delivery or damage/defects that are found to have occurred during transit. Any complaints relating to products purchased from the site will not be considered more than 30 calendar days beyond the initial date the order was received.
You have to check all goods received at the time of the delivery and indicate, if possible in the return email send to our Customer service team, any noted abnormalities (an opened package, damaged items, defects etc.).

In case of a problem arising with any purchased products, or if you are not completely satisfied with the chosen items, you are able to return them for a full refund, or exchange them in accordance with the conditions set out in the section "Returns - Exchanges - Refunds".
RETURNS – EXCHANGES - REFUNDS
Customers have the right to return any item purchased on the site miccys.com and request for an exchange or full refund for any items that they are not satisfied with providing that the request is received no later than 15 calendar days from receipt of the order, and if the following conditions are met:
Returned items must be accompanied with their original invoice or, in the case of request for a partial refund, with a copy of the invoice, and goods must be in their original state and packaging. Goods should be returned to the following address:

In a quest for continuous improvement of our website, we would like to know the reasons for your return. You can send us an email for this purpose, please specify whether you prefer an exchange or a refund and send us the email with the motive of your return.
In the case of exchanges:
- If the quoted prices of the items selected for exchange have a value exceeding the value of the items being returned, the customer will be required to settle the difference in accordance with the current ‘General Conditions of Sale’.
- If the quoted prices of the items selected for exchange have a value lower than the value of the items being returned, the price difference will be refunded by MICCY’S in accordance with the current ‘General Conditions of Sale’.
In cases where an exchange is requested, shipping costs for the initial delivery are not refunded. A single exchange of respective orders is possible.
The exchange only rarely involves the reservation of an item. If upon receipt of the package return the item requested in exchange is not available in stock, the customer cannot claim it. MICCYS.com will then propose to the customer another product or a refund.
In cases of request for refund , and in accordance with your statutory rights as a consumer, customers are entitled to request for refund for any items ordered from the site shop.miccys.com providing that notice is received no later than 15 calendar days after to date of delivery. Products returned in their original state and packaging as indicated in the previous section. MICCY’S will endeavor to have appropriate funds refunded to your debit/credit card within 15 working days after receipt of the unwanted merchandise. In all cases, in line with your entitlement to return, refunds will be completed no later than 30 days after receipt of returned goods.
In the case of refunds, it is not possible for an electronic credit note to be issued for future use against purchases on the MICCYS.com, nor are we able to issue credit vouchers to be used in Miccy’s stores/ points of sale. We are unable to offer refunds, even partial, if the item(s) in question was received as a gift, only exchanges.
In the case of a request for a refund, and in accordance with your statutory rights as a consumer, you will be fully refunded the original shipping costs charged by Miccy’s only In cases of request for either exchange or refund that arise from there being a problem/defect with items received (wrong item dispatched, product damaged/faulty etc) will the costs incurred in returning the items be refunded.
MICCY’S has final discretion in deciding if returned items are in their original condition when received by MICCYS.com.
MICCY’S will not be responsible in case of losses of merchandise arising from an incorrect address being provided, or for the delay in return delivery to shop.miccys.com of products you wish to exchange/receive a refund, in-so-far as the inherent risks taken and undertaken in return shipping of items for exchange/refund rest solely with you.
We do not offer the option of exchanges or refunds for items purchased in Miccy’s stores or points of sale being processed through the site MICCYS.com – these need to be sought from the store from which the items were originally purchased.
All products are come with a one year guaranteed that covers "parts/materials and handiwork” – beyond this deadline, an estimated cost of repair will be agreed with the customer.
Beyond the warranty period, a customer will be billed with the cost of repair once acceptance of the estimate has been formally recognized. No repairs will be undertaken prior to acceptance of the estimate and agreed costs for repair have been received.
Customers are liable for the cost of sending items for repair, but return postage of said items, once they have been repaired, the return costs are covered by MICCY’S.

When shipping items to us for repair, it is essential you include in the package delivery details of where you would like your items returned, as well as a contact e-mail address and telephone number.
Alternatively, customers are free to deposit and/or collect items for repair at the aforementioned atelier address given in The Netherlands.
Products sold on the site miccys.com are subject to the legal guarantees pertaining to the rights of the consumer outlined in the ‘Dutch Civil Code’, as well as the ‘Dutch Consumer Code’.
LIMITATION OF RESPONSIBILITY
You use the website MICCYS.com at your sole and entire responsibility and discretion.
MICCY’S cannot be held responsible for direct or indirect harm of any sort, in particular, material harm, loss of data or programs, financial loss, which result from the either the use of this Web site or of sites with which it is linked, or from the purchase of goods available for sale on it.
STATUTORY RIGHTS – DISPUTES
The present ‘General Conditions of Sale’ are governed and interpreted according to Dutch law without taking into account principles of conflicting international laws. The application of the United Nation Convention pertaining to contracts regarding the international sale of goods is hereby expressly rejected. In cases of dispute, the Dutch courts have exclusive jurisdiction and you are called to recognize and accept their exclusive jurisdiction. MICCY’S reserves the right to acquire and to obtain injunction or ruling for the defense of its rights in accordance with the present article.

The site miccys.com is administered and published by the company MICY’S B.V. MICCY’S shares the same philosophy as the creator of the Miccy’s brand and acts as their authorized distributor, which gives them exclusive rights to sell a selection of their branded merchandise on the site miccys.com.
Users of the site miccys.com are also required to abide by and be agreement of the miccys.com site’s policy regarding confidentiality (see ‘Confidentiality Policy’).
MICCY’S can update at any time their ‘General Conditions of Use’ and their ‘Confidentiality Policy’.
